These are the standard terms of our wedding photography and videography agreement. Every booking is made on a written offer and Agreement; the Agreement you accept, with its price, dates and payment schedule, is the one that applies to your booking.

Payments

The booking is confirmed when the advance (booking fee) shown in your Agreement is paid; the balance is paid on the schedule in your Agreement. You can pay online through Razorpay (cards, UPI, net banking) using the secure link we send you, or directly to our bank account or UPI. You pay exactly the amount due; we bear the payment gateway's fee.

The Agreement

We, the Photographer and the Client, firmly and cordially agree to the following terms in this wedding photography agreement. This Agreement is designed to benefit the Client while ensuring a fair and balanced approach that safeguards the interests of the Photographer.

Agreement Basis. This Agreement is a result of mutual consent. Any changes or modifications to this Agreement must be documented in writing and agreed upon by both parties.

Effective Commencement. The agreement for our wedding photography services takes effect from the date of your booking confirmation, accompanied by the advance payment.

Communication. The Photographer will exclusively liaise with the Client regarding all matters related to this Agreement and the booking.

Attendance and Coverage. The Photographer assures their presence on your special days, ready to provide you with the photographic package you've selected.

Contingency Plan. In unforeseen circumstances where the Photographer is unable to attend your wedding due to illness or other unexpected situations, rest assured that a competent replacement photographer will be arranged.

Price Assurance. The agreed-upon price in this Agreement remains stable and unchanged throughout (till your last event date), ensuring that there are no surprises. The Offer is valid for acceptance till the validity date printed on your offer.

Booking Fee. To secure your chosen dates, a non-refundable booking fee stated in your Agreement is required as per our payment terms. In the unlikely event of a cancellation due to a Force Majeure Event, the booking fee can be applied to a future event at your discretion.

Rescheduling Flexibility. "Should you wish to change your originally booked dates, a rescheduling fee of INR 25,000 applies, and the new dates are subject to our availability. We will always do our best to be with you on your new dates; however, if our team is already committed elsewhere on them, we will regretfully have to treat the change as a cancellation by the Client, and payments made cannot be refunded.

Final Payment. To ensure our seamless partnership, you are expected to make the full payment of the photography package as per the terms outlined in this Agreement.

Quality Commitment. We are dedicated to delivering the highest quality photographic services, based on prevailing conditions.

Limited Liability. In the rare event of photographic failure, or of any unforeseen circumstance beyond our control, the Photographer's liability is limited to a refund of the work lost, and no more. Where an event day is affected, this is that day's share of the Agreement price; where a single deliverable is affected, it is that deliverable's share. If all of the work is lost, the refund is of all payments made. We are not liable for any other consequential, indirect or emotional damages.

Copyright and Usage. We retain the copyright of all images, which may be used for promotional purposes. We also have the right to prohibit the commercial use of the images by the Client and third parties without our permission.

Editing Control. Only the Photographer has the authorisation to edit the photographs, ensuring the consistency and quality of the final product.

Image Selection. We have made it convenient for you to select images; a link will be provided, and you will have 30 days to make your selections. A draft of the album (in PDF format) will be provided, and any changes to the draft must be communicated within 5 days. Please note that delays on your part in completing these activities may extend the final delivery time.

Cinematic Video. Our commitment to excellence extends to the cinematic video. You may request minor changes within 5 days of receiving the video. We will promptly address these changes within 10 working days. To maintain the video's rhythm, we kindly request that no alterations be made to the song choices. If specific song track requirements exist, please provide the song/music track and event details before the event date.

Traditional Video. The traditional video encompasses 1 to 4 hours of footage. We will add songs and music tracks to complement your event. Should you prefer to select your own music tracks, you have the option to do so. These songs/music tracks must be provided to the Photographer before the event.

Delivery Schedule. Changes in the delivery schedule may occur if you request modifications to your selected services: Traditional video delivery will extend by an extra 15 days; Cinematic video delivery will extend by an extra 15 days; album/storage-device handover will extend by 7 days.

Revised Schedule = committed Schedule in this contract + Days taken to communicate changes + extra Days mentioned above in this clause.

Eg. Delivery schedule: 30 days from the event date, 5 days to communicate changes after release of Traditional video + 15 days as mentioned in this contract. Revised Schedule = 30+5+15 = 50 Days.

Cancellation Policy. Where the Client cancels the booking, we regret that we cannot entertain refund requests: payments made against a cancelled booking are non-transferable and non-refundable. This does not affect your rights under the Limited Liability or Government Restrictions clauses above..

Government Restrictions. If government restrictions prevent your wedding on the specified dates, you may reschedule to a new date, subject to our availability, or opt out of our services. On a reschedule, the contract cost is adjusted accordingly and the booking fee carries to the new date. Opting out is treated as a cancellation by the Client: all other payments are refunded, and the booking fee stated in your Agreement is retained.

Taxes. Any applicable taxes are not included in the Agreement price and will be applicable separately.

Force Majeure. We understand that unforeseeable circumstances can affect our performance. We will not be held responsible or liable for delays or failures resulting from uncontrollable events, as outlined in this Agreement.

Timely Product Delivery. We are committed to delivering your product as specified in this Agreement within the proposed schedule, subject to the Force Majeure clause. This ensures that you receive our services in a timely manner.

Force Majeure

Definition. The term "Force Majeure Event" refers to any unforeseeable and uncontrollable circumstance beyond our reasonable control or that of the Client. This includes acts of nature, pandemics, government actions, and other unpredictable events that make it impossible or illegal to perform under this Agreement.

Communication. In case of a Force Majeure Event that impacts our performance, we will promptly communicate the details to you.

Mitigation. We will make every reasonable effort to minimise the impact of a Force Majeure Event and resume our services as soon as practicable.

Time Extension. The occurrence of a Force Majeure Event will extend the time for us to fulfil our obligations under this Agreement.

Termination. If a Force Majeure Event continues for a specified duration, either party has the option to terminate the Agreement. In such a case, we will not be liable for any damages or penalties due to the termination.

Limitation of Damages. We want to emphasise that in the event of a Force Majeure Event, neither party is liable for any consequential or special damages incurred by the other party.

Good Faith. We commit to acting in good faith and cooperating to address the impact of a Force Majeure Event, ensuring a fair and reasonable resolution under the circumstances.

Continuation of Agreement. The remaining terms of this Agreement remain in full force and effect, even in the presence of a Force Majeure Event, unless the Agreement is terminated as outlined in the Force Majeure clause.

We've thoughtfully crafted it to strike a balance between flexibility and professionalism, creating a partnership that ensures your celebration is captured in the most beautiful way.

We are dedicated to providing comprehensive coverage of the entire event in accordance with the schedule you've provided. While we understand that minor adjustments to the schedule may be necessary, rest assured, we are wholeheartedly committed to adapting to these changes to the best of our ability.
